Terms of Service

These terms govern your use of withfeedback.com (“the Service”), operated by APPLIKU DOO NOVI SAD (“we”, “us”). By creating an account or using the Service you agree to them. If you are agreeing on behalf of a company, you confirm you are authorised to do so.
1. What the Service does
withfeedback.com collects feedback and testimonials from your customers, lets you moderate them, and displays the ones you approve — on pages we host and through an embeddable widget on your own site. It also provides an HTTP API and tooling for use by scripts and AI agents.
2. Accounts
- You need a valid email address, and you are responsible for what happens under your account, including anything done by your team members.
- Keep your credentials and API tokens secret. Tell us promptly at support@withfeedback.com if you believe an account or token is compromised.
- One person may hold several accounts, but creating accounts to evade plan limits, a suspension, or a trial restriction is not permitted.
3. Your content, and who owns it
Testimonials, feedback, contact details, video, images and any other material you or your customers submit remain yours. We claim no ownership of it. You grant us only the licence needed to run the Service: to store it, process it, transcode video, and display the items you have approved in the places you have configured.
We own the Service itself — the software, the interface, the widget, the documentation and our trade marks. Nothing here transfers any of that to you.
4. Consent is your responsibility
This is the obligation that matters most on this page, so it is stated plainly. When you publish a testimonial you are publishing a real person's words, name, likeness and sometimes their face and voice. You are responsible for having their permission to do so, and for honouring its withdrawal.
- Only publish a testimonial where the person has consented to it being displayed publicly. The Service records consent and refuses to approve a testimonial that lacks it, but the underlying permission is yours to obtain.
- Act on withdrawal. The Service provides a withdrawal link and removes the item from public display when consent is withdrawn.
- Do not edit a testimonial so that it misrepresents what the person said.
- Do not use the Service to collect or publish material about children where you do not have the necessary consent from a parent or guardian.
5. Acceptable use
You agree not to use the Service to:
- publish fabricated testimonials, or content presented as coming from a person or organisation who did not provide it;
- publish unlawful, defamatory, harassing, or infringing material;
- send unsolicited bulk email, or import contact lists you have no basis to contact;
- probe, overload or interfere with the Service or the infrastructure it runs on, or attempt to bypass rate limits, plan limits or abuse controls;
- upload malware, or use the video pipeline to process material unrelated to feedback and testimonials;
- resell the Service, or use it to build a substantially similar competing product.
We apply automated abuse controls — rate limits, per-project caps and blocklists. These protect every customer on shared infrastructure and are not negotiable per account.
6. Plans, billing and refunds
- Paid plans are billed in advance through Paddle, our merchant of record. Paddle handles payment, invoicing and applicable sales tax or VAT, and their terms apply to the payment itself.
- Subscriptions renew automatically until cancelled. Cancelling stops future charges; it does not refund the current period.
- Unless the law requires otherwise, fees already paid are not refundable. If something went genuinely wrong, write to support@withfeedback.com — we would rather resolve it than stand on this clause.
- Plans carry usage limits (submissions, published testimonials, video minutes, team members). Exceeding a limit does not incur a surprise charge; it stops the metered action until the next period or an upgrade.
- We may change prices with reasonable notice. A change never applies to a period you have already paid for.
7. Availability
We work to keep the Service available and we do not offer a contractual uptime guarantee. We may take it down for maintenance, and we will avoid doing so without warning where we reasonably can. Widget delivery is served from a CDN so that your site keeps rendering approved testimonials during our own maintenance windows.
8. Suspension and termination
You may stop using the Service and delete your account at any time. We may suspend or terminate an account that breaches these terms, creates legal or operational risk, abuses shared infrastructure, or has unpaid fees. Where circumstances allow we will contact you first. On termination we delete your data as described in the Privacy Policy.
9. Warranties and liability
The Service is provided “as is”. To the extent the law permits, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement.
To the extent the law permits, we are not liable for indirect, incidental or consequential loss, nor for lost profits, revenue, goodwill or data. Our total liability for any claim relating to the Service is limited to the fees you paid us in the twelve months before the claim arose. Nothing here limits liability that cannot lawfully be limited.
Keep your own records. We take backups for our own operational purposes, and you should not treat the Service as the only copy of testimonials that matter to your business. Export is available at any time.
10. Indemnity
You will indemnify us against claims arising from content you publish through the Service, including claims that you published a person's words or likeness without their permission.
11. Changes to these terms
We may update these terms. For material changes we will give notice by email or in the application before they take effect. Continuing to use the Service after that means you accept the updated terms. The date at the top of this page shows when it last changed.
12. Governing law
These terms are governed by the law of the Republic of Serbia, and the courts of Novi Sad, Republic of Serbia have exclusive jurisdiction over any dispute. If any provision is held unenforceable, the rest remains in force.
